RENTAL AGREEMENT

 

 

Texas Masterpiece At 105 And 107 W. 3rd Street, Eddy, Texas 76524 Is Owned And Operated By:

Marla K. Moser Dba Texas Masterpiece.

 

1.      Rental fees are subject to change without notice.

2.      Usage In General

a.     At the sole discretion of the owner, organizations, businesses or individuals at least 21 years of age (renting parties) may rent portions of the Texas Masterpiece fine art

3.      Gallery For Public And Private Events.

a.     All arrangements, including, but not limited to dj’s, bands, sound systems, ice machines, margarita machines, tents, electrical catering equipment and deliveries by agents must be approved by the owner or the representative of the owner one month in advance of the date of the rental. Kegs are not allowed anywhere on Texas Masterpiece property. Failure to abide these terms will result in cancellation of the rental agreement and loss of the deposit.

b.     The facility shall be referred to as Texas Masterpiece Fine Art Gallery. 107 W. 3rd Street, Eddy, Texas 76524.

4.      Hours Of Availability

a.     The Texas Masterpiece (including restrooms), kitchen and courtyard may be rented for use between 4:30 pm to midnight weekends (Friday, Saturday, Sunday). Renting party and all guests must be off the property by 12 midnight. There will be no exceptions granted. The renting party must exit the grounds at the end of the rental period. Any time over the allotted rental period will result in an additional charge at the hourly rate.

5.      Reservation Regulations

a.     Rental will be on a first come-first served basis. Reservations can be made through the Texas Masterpiece office, either in person with a confirmed appointment or by phone during the hours of 9:00 a.m. - 5:00 p.m., Monday through Friday (with the exception of holidays) and 10 am –5:30 p.m. on Saturdays and Sundays. No reservation is valid until confirmed and the deposit is paid in full.

b.     Reservation confirmation will consist of an executed rental agreement that will be issued no more than one (1) year in advance of the function.

c.     Confirmation of any reservation is complete when a deposit and all rental fees have been received by the Texas Masterpiece office and an executed rental agreement is issued.

d.     Reservations will be booked for a minimum of six (6) hours. Time blocks should include all necessary preparation and breakdown of the function, including set up by caterer, florist, etc. Time blocks shall begin on the hour or the half hour. Any part of an additional hour(s) for any rental or services (security, attendant, set up/breakdown) will be charged the full hour rate.

e.     In the event of unforeseen circumstances, and in the public interest, the Texas Masterpiece reserves the right to cancel or deny any reservation or rental. In such case, fees and deposits will be returned in full.

6.      Fees And Deposits

a.     A non-refundable deposit is required on all rentals at the time the reservation is confirmed by issuance of an executed rental agreement. All rental fees are due and payable thirty (30) days prior to the date of the rental. The deposit of $300.00 for an event with no alcohol being served, or $500.00 with alcohol, is required. Deposits are required to cover damages, overtime, littering of the grounds and missing inventory. The renting party is responsible for litter and refuse removal. Any damage to the building or grounds or inventory in excess of the deposit will be charged directly to the renting party’s credit card.  A valid credit card from the renting party will be made available for said charges.

b.     Cancellations occurring less than thirty (30) days from the date of the event will result in forfeiture of all fees paid.

c.     If all terms of the rental agreement are met, the renting party will receive a refund of their deposit, less charges, within three weeks after the function. Any outstanding rental fees are first applied before any deposit refunds.

d.     The Texas Masterpiece office will retain all deposits until all monies owed the Texas Masterpiece have been received in full. Deductions will be made for damages, failure to remove litter and refuse, overtime, and missing inventory.

e.     Security will be required at a function where alcohol is served.  (one security guard for each 150 persons.) Security will not be provided by the Texas Masterpiece.  The renting party will pay the cost of the security directly to the security service.  Security must be present for the duration of the event.

f.     A building attendant from the Texas Masterpiece will be required when an event begins until the event ends. The Texas Masterpiece will provide a building attendant. The renting party will pay the cost of the attendant to Texas Masterpiece.

g.     Rental party must abide by all governmental laws and regulations.

h.     Forfeiture of deposit will result if renting party’s responsibilities are not met.

 

 

 

7.      Usage Regulations

a.     Smoking is prohibited in any portion of the Texas Masterpiece.

b.     Tents may be allowed only after permission has been obtained from the Texas Masterpiece office. Tents must be secured with water barrels.

c.     No decorations are permitted without the permission of the Texas Masterpiece.  Absolutely no screws or nails are allowed to secure decorations. Only floral wire may be used. All decorations must be removed from the premises upon departure. Texas Masterpiece is not responsible for any items left on the premises

d.     No rice, birdseed, confetti, or glitter may be thrown inside the facility. Only birdseed, soap bubbles or fresh flowers may be thrown outside the building

e.     Trivets must be used for all hot, cold, or moist dishes. The renter must inform the caterer of this rule.

f.     Renter shall be responsible for the removal of renter’s property and shall leave the building and grounds in their original condition. All trash shall be properly packaged and placed in the trash container.  If the trash container becomes full the trash must be removed.  No trash may be left on the premises outside the containers

g.     The person responsible for the rental agrees not to leave the premises until all guests, caterers, musicians, florists, etc. Have left and until the Texas Masterpiece representative has inspected the premises. Any damage, including theft, will be the responsibility of the renter. Charges for damaged items will be based on its repair or replacement cost as determined by Texas Masterpiece. If repair or replacement cost is more than the deposit, the renter will be financially responsible for the cost not covered by the deposit.

h.     Sparklers and other fireworks are banned.

i.     No animals are allowed, except those used to assist individuals with disabilities

j.     Wine and beer are the only alcohol beverages permitted as long as the winery license regulations permit.

k.     All services such as florists and catering are the responsibility of the renter.

l.     Use of any Texas Masterpiece equipment or furniture must be arranged in advance with the Texas Masterpiece office as part of the rental agreement. The Texas Masterpiece provides some furniture (chairs, tables, etc.).  Other furniture to be supplemented by outside rental companies must be approved by Texas Masterpiece.

m.     No Texas Masterpiece fixtures, furniture, equipment or other property may be moved, relocated or rearranged without prior approval by the Texas Masterpiece office under no circumstances will the removal of artwork on display in the Texas Masterpiece hall be allowed without written approval in the rental agreement by a Texas Masterpiece official.

n.     Fire codes, as imposed by the eddy public safety’ department, must be met at all times

o.     Vehicle and building entrances and exits must remain clear and accessible at all times.

p.     No open flame candles are allowed. Votive, floating or hurricane candles and floor candelabra are not permitted. (Only sternos can be used by caterers for warming food.)

q.     Decorations or promotional materials (circulars, flags, posters, etc.) Must be approved in advance by the Texas Masterpiece office.

r.     No food, drink or decorations may be placed on electric equipment, musical instruments, or artwork.

s.     Under no circumstances shall anything be dumped in gardens, or on lawns. This includes beverage remains, ice, and water from ice chests.

t.     The renting party will be held liable and be responsible for providing transportation for an intoxicated guest. Rental Party acknowledges that the Texas Masterpiece will not be responsible for intoxicated guests at the Rental party’s event.

u.     Vehicles are allowed on Texas Masterpiece parking lots. Additional public parking is available at specific locations to be marked.

v.     Participatory athletic events are prohibited

w.     Texas Masterpiece, the owners and employees assume no responsibility for any property of the renter or guests placed in or on the building or grounds. Texas Masterpiece, its owners, employees, and its agents is released and discharged from all liability for loss, injury, or damage to person or property sustained during use or occupancy. The renter agrees to indemnify and hold harmless Texas Masterpiece, its owners, employees, and its agents for all suits, actions, losses, damages, claims, or liabilities of any character, type, or description, including court costs and attorney’s fees, for damage to property or injury or death to any person, including renters, invitees, licensees, and trespassers, or as a result of any cause of action, including any allegation of any nature involving the use or consumption of alcohol

x.     These rules are made for the protection of the guests and for the preservation of Texas Masterpiece. We appreciate your cooperation. Failure to abide by any of these rules will result in the forfeiture of the full deposit

 

8.      Included In Rental Fee:

a.     Lights

b.     Heat/air conditioning

c.     Restrooms

d.     Indoor tables and chairs (up to 7 tables 26 chairs)

e.     Hand towels and toilet tissue

 

9.         Additional fee-based services required:

a.     Unarmed security officer ($15 to $20/hour)

b.     Building attendant ($20/hour)

c.     Clean-up attendant $75.00 fee.

Provided by renting party

d.     Food service, glassware, silverware, flatware. Tablecloths trash bags and other kitchen supplies

e.     Special equipment, supplies and accessories decorations (facility provides two stainless steel tables on rollers,)

f.     Additional tables and chairs are available for rent through an approved rental service.

g.     Outdoor furniture (facility provides some outdoor tables and chairs in the courtyard area)

I have read and understand my responsibilities with regard to the rental and use of Texas Masterpiece. In the event that the renter, his or her guests, or his employees fails to comply with these rules and regulations, the deposit will be forfeited to Texas Masterpiece.

Please fill out rental agreement and return it with your $300 deposit ($500 when alcohol is served). Paying this deposit will secure your reservation. All payments are due thirty(30) days prior to scheduled event.
